Termini di servizio

La traduzione italiana di queste condizioni generali è in fase di aggiornamento. Nel frattempo trovi qui sotto la versione inglese. Fa fede la versione tedesca.

§ 1 Scope and provider

(1) These Terms and Conditions apply to the use of the website afasteryou.com, the web platform and the “A Faster You” app for Android and iOS (together “A Faster You”) and to all contracts concluded through them.

(2) The provider and your contractual partner is Aerotune GmbH, Kreuzkoppel 134a, 24943 Flensburg, Germany, represented by its managing director Sebastian Schluricke, registered at the local court (Amtsgericht) Flensburg HRB 12004, VAT ID DE309237761, phone +49 (0) 177 4447664, email: info@afasteryou.com (“we”).

(3) Deviating terms of users do not apply unless we expressly agree to them.

§ 2 Services

(1) A Faster You is a training platform for endurance athletes. It estimates metabolic values (e.g. VO2max, VLamax) and training zones from your training and body data, creates a training plan and adapts it continuously.

(2) We offer free access (Freemium) with limited features and paid memberships (Premium). We describe the scope of each membership and the prices on afasteryou.com and in the app before you subscribe.

(3) For coaches, teams and clubs we offer a coach licence. Its scope (coach logins, coached athletes, included analyses) and which Premium activations are additionally required for coached athletes follow from the coach offer at the time of purchase. The coach licence is intended exclusively for businesses within the meaning of Section 14 BGB (e.g. coaches, teams, clubs). By purchasing it you confirm that you acquire it for your commercial or independent professional activity; the consumer right of withdrawal (§ 8) does not apply to it.

(4) The AI coach is an automated chat based on a language model. It is only available if you have separately agreed to the related data processing (see Privacy Policy).

(5) You can connect your account to services of other providers (Zwift, Garmin, Wahoo, ROUVY, Polar, Suunto, Hammerhead). The terms of the respective provider apply to these services. Their availability is outside our control; if a provider changes or discontinues its interface, the connection may stop working.

§ 3 Account and minimum age

(1) You need an account to use the service. You can create it with an email address and password or via Google or Apple.

(2) A Faster You is intended for people aged 18 and over. By registering you confirm that you are at least 18 years old.

(3) Provide the information needed for the contract and for calculating your training accurately and keep it up to date. Incorrect body data leads to incorrect calculations.

(4) Keep your login details secret. If you notice that someone else is using your account, write to us immediately.

§ 4 Conclusion of contract

(1) On the web: you create an account, choose a membership, check your details on the summary page and complete the order with the order button. We then forward you to PayPal. The contract is concluded when we confirm your order.

(2) In the app: you take out paid memberships via Google Play or the Apple App Store. The purchase, payment and confirmation take place via the respective store; its terms apply in addition.

(3) After conclusion you receive a confirmation from us by email with the content of your contract and these Terms in the version valid at the time, even if you purchased in the app. We do not store the contract text for you to retrieve separately; please keep the email.

(4) The contract language is German.

§ 5 Prices and payment

(1) The prices shown to you before you subscribe apply. They include statutory VAT.

(2) On the web you pay via PayPal. The amount is due at the start of each term.

(3) In the app you pay via Google Play or the Apple App Store; their payment terms apply.

§ 6 Trial period

(1) We may offer a free trial period. We show you its length and whether it turns into a paid membership before it starts.

(2) A trial without a stored payment method ends automatically; your account then returns to Freemium.

(3) If you take out a membership with a preceding trial, billing starts when the trial ends unless you cancel before. Before the start we show you the price afterwards, the billing interval and that the membership continues afterwards.

• On the web, cancelling before the end of the trial is sufficient.
• In the Apple App Store you must cancel at least 24 hours before the end of the trial to avoid being charged.
• On Google Play, Google Play's procedure applies; Google shows you the deadline when you subscribe.

(4) Only one trial of each kind is intended per person.

§ 7 Term, renewal, cancellation, account deletion

(1) The initial term of a paid membership (e.g. one month or one year) follows from the offer you choose when subscribing. You can cancel at the end of the initial term. If you do not cancel, the membership then continues for an indefinite period and can be cancelled at any time with one month's notice.

(2) You can cancel:

• on the web without signing in via the cancellation page https://afasteryou.com/kuendigung/ (link “Cancel contract here” at the bottom of every page),
• by email to info@afasteryou.com,
• for memberships from the app, also in Google Play or the App Store. If you cancel towards us, receipt of your cancellation by us is decisive; we confirm the end date to you. Deleting the app does not end a subscription.

(3) After a membership ends, your account remains as a Freemium account.

(3a) We may also cancel a paid membership with one month's notice to the end of the current term. We refund proportionately anything you paid in advance for the period after the end of the contract.

(4) The right to terminate for good cause remains unaffected. Good cause for us is in particular a serious breach of § 9.

(5) You can delete your account at any time (on the web under Settings → Account → Privacy, in the app under Settings → Danger zone). The deletion request deactivates your account immediately; after seven days it is deleted permanently, which ends the free user relationship. We cancel a running web membership with the deletion request; no further charges are made. Account deletion alone does not cancel a store subscription; cancel it in the store or towards us (para. 2). There is no refund for a period already paid that you no longer use because of the deletion; statutory refund claims, in particular on withdrawal, price reduction or justified termination, remain unaffected.

§ 8 Right of withdrawal for consumers

Cancellation policy (translation of the statutory German model)

Right of withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day the contract is concluded.

To exercise your right of withdrawal, you must inform us (Aerotune GmbH, Kreuzkoppel 134a, 24943 Flensburg, Germany,
phone: +49 (0) 177 4447664, email: info@afasteryou.com) of your decision to withdraw from this contract by an unequivocal
statement (e.g. a letter sent by post or an email). You may use the attached model withdrawal form, but it is not
obligatory.

You can also exercise your right of withdrawal online at https://afasteryou.com/widerruf/. If you use this online function, we will send you, without delay, on a durable medium (e.g. by email) an acknowledgement of receipt with information about the content of the withdrawal and the date and time of its receipt.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement. We will not charge you any compensation for the services provided until the withdrawal.

End of cancellation policy

Purchases in the app: For memberships from Google Play or the App Store you can also declare the statutory withdrawal towards us. The refund may technically be made via the respective store. Additional refund options of the store are governed by its terms and leave your statutory rights unaffected.

§ 9 Obligations when using the service

You may use A Faster You only for your own training or — with a coach licence — for coaching your athletes. In particular, you may not:

• decompile, modify or systematically extract the platform, the app or their content (e.g. by automated requests), unless expressly permitted by law;
• share logins or use one account for several people;
• upload data of other people without their consent;
• use the AI coach for unlawful purposes or deliberately steer it towards content that harms others.

We may restrict access temporarily and only to the extent necessary if there are concrete indications of a serious breach of these rules or a threat to the security of the platform or your account. We inform you of the reason and scope and give you the opportunity to respond; in case of urgent danger, this may happen after the restriction. Once the reason no longer applies, we lift the restriction. Statutory rights remain unaffected.

§ 10 Health and responsibility

(1) A Faster You gives training recommendations based on your data and statistical models. The values are estimates. A Faster You is not a medical device and does not replace a medical examination, diagnosis or treatment.

(2) Only train when you are healthy. Have a medical check-up before starting intensive training if you have pre-existing conditions, have not trained for a long time or are unsure. Stop a session if you notice pain, dizziness, shortness of breath or other warning signs.

(3) Replies of the AI coach are generated automatically and may be wrong or incomplete. They are not medical advice. Check recommendations with your own judgement.

§ 11 Availability and further development

(1) We strive for availability with as few interruptions as possible. Maintenance, security updates and disruptions beyond our control may cause short interruptions.

(2) We provide updates required to keep the service in conformity with the contract (Section 327f BGB). Beyond that we change features only for a valid reason: to adapt A Faster You to changed operating systems, changed or discontinued interfaces of connected services or new legal requirements, to adapt our calculation methods to new scientific findings, or to remove specifically identified security risks or usability obstacles. Changes are made only to the extent justified by the respective reason and at no additional cost to you; the agreed core of the service remains.

(3) We inform you about such changes clearly and comprehensibly. If a change impairs your access or the usability more than insignificantly, we inform you by email within a reasonable period before the change about its features, its timing and your rights. You may then terminate the contract free of charge within 30 days; the period starts when you receive this information or, if the change is made later, when it is made (Section 327r BGB).

§ 12 Warranty

For consumers, the statutory rights under Sections 327 et seq. BGB apply to defects of our digital products. For other customers, the statutory warranty rights applicable to their contract apply. The calculated training and metabolic values are model-based estimates. This note limits neither the agreed quality of our services nor your statutory warranty rights.

§ 13 Liability

(1) We are liable without limitation for intent and gross negligence, for damage resulting from injury to life, body or health, under the Product Liability Act and to the extent of any guarantee given.

(2) In case of slightly negligent breach of an essential contractual obligation — an obligation whose fulfilment makes the proper performance of the contract possible in the first place and on whose compliance you may regularly rely — our liability is limited to the foreseeable damage typical for the contract.

(3) Otherwise our liability for slight negligence is excluded.

(4) These limitations also apply to our employees and vicarious agents.

§ 14 Coaches, teams and coached athletes

(1) If you link your account to a coach, the coach can see your tests, calendar, activities and profile. You can end the link at any time.

(2) With a coach licence you can coach athletes and also create athletes without their own login in your account. You may only enter data of coached athletes if there is a sufficient legal basis and the athletes have received the required data protection information. Where consent is required, you obtain it beforehand in a verifiable way; for health data it must be explicit. This also applies to the use of their data in the AI coach. Our own data protection obligations remain unaffected.

§ 15 Your data and content

(1) Your training data belongs to you. You can delete it at any time.

(2) To improve our own calculation models we use anonymised powertest results from which a person can no longer be identified by means reasonably likely to be used. We may continue to use such results after your account has been deleted. Details are in the Privacy Policy.

§ 16 Data protection

How we process your data is described in our Privacy Policy at afasteryou.com/en/legal/privacy/.

§ 17 Changes to these Terms

For existing contracts, the Terms you agreed to when subscribing apply. We offer changes to you by email; they only take effect if you expressly agree. If you do not agree, your contract continues on the previous terms. This also applies to price changes. The right of cancellation under § 7 remains unaffected. Changes to A Faster You itself are governed by § 11. For new contracts the version shown at the time of conclusion applies.

§ 18 Final provisions

(1) The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer habitually resident in another country, the mandatory consumer protection provisions of that country remain unaffected.

(2) The German version of these Terms is binding; translations are provided for convenience.

(3) We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.

(4) Should any provision of these Terms be invalid, the remainder of the contract remains valid; the statutory provision replaces the invalid one.
